The Kentucky Cabinet for Health and Family Services (CHFS) has issued emergency regulations for Behavioral Health Services Organizations (BHSOs) which became effective July 1. These regulations were issued on an emergency basis to implement the state’s 1115 substance use disorder (SUD) waiver. The public comment period on these regulations will be held in August, with any public comments due by August 31.

One of the regulations amends state licensure requirements for BHSOs offering mental health treatment [902 KAR 20:430]. The remainder address Medicaid coverage and payment for BHSO services.

Action Needed

KHA staff has reviewed these regulations and did not identify particular issues. However, please review the changes, including the new regulation governing BHSO SUD services, and contact Nancy Galvagni at KHA (ngalvagni@kyha.com) by August 15 if changes are needed so KHA can file comments before the August...

In correspondence dated December 31, 2018, in light of four recent appellate court decisions, the Centers for Medicare and Medicaid Services (CMS) is withdrawing questions 33 & 34 from the Medicaid Disproportionate Share Hospital (DSH) guidance that was issued in January 2010 titled, “Additional Information on the DSH Reporting and Audit Requirements,” available at: https://www.medicaid.gov/medicaid/finance/downloads/part-1-additional-info-on-dsh-reporting-and-auditing.pdf.

As a result, frequently asked questions (FAQs) 33 and 34 are no longer operative, which means payments received from third-party payors on claims for Medicaid eligible patients will no longer be offset in determining Uncompensated Care.

CMS will accept revised DSH audits that cover hospitals' services furnished before June 2, 2017. CMS has not yet given up arguing their case for the periods...

The Cabinet for Health and Family Services (CHFS) is sponsoring and funding two free training sessions on the American Society of Addiction Medicine (ASAM) Treatment of Opioid Use Disorder (OUD) Course. The course is designed to help practitioners who work with opioid use disorder patients to obtain a waiver to prescribe buprenorphine in office-based treatment of OUDs. 

The first training will be on February 24 in Lexington, and the second training will be on March 10 in Hazard. Visit the corresponding links for session details and registration information.

Hospitals and other health facilities should be aware that the Cabinet for Health and Family Services (CHFS) has filed changes to 902 KAR 20:008 License procedures and fee schedules. The regulation will go into effect in March. The regulatory changes would:

Require health facilities to obtain a provisional license prior to operation, which is in effect until the Office of Inspector General conducts an inspection of the facility and determines the facility is fully compliant with licensure regulations. Require written notice to the Office of Inspector General (OIG) within 30 days in cases of a change of ownership in a health facility. Prohibit an individual or party from acquiring a significant financial interest in a licensed health facility or service if that party has had a license or certificate to operate...

The KHA Certificate of Need (CON) Committee is in the process of reviewing the State Health Plan and CON regulations, and discussing the need to update and improve portions of the program in order to streamline and modernize CON in Kentucky. Two events have prompted this thorough review.

First, the Bevin administration and the Office of Health Policy are focusing on reducing red tape which impedes appropriate growth and business activities. KHA member hospitals would like to be proactive partners in this effort. Secondly, the Office of Health Policy announced in the February CON Newsletter that comments on the 2017 State Health Plan will be accepted between March 1 and March 31. KHA is working towards this deadline in getting final recommendations from the CON Committee and reviewed for approval by the KHA Board of trustees. The KHA Board did approve some CON Committee recommendations during the February 23 Board meeting, but there are other areas of the plan that are being reviewed and discussed....

On Thursday, the Cabinet for Health and Family Services (CHFS) released a fact sheet on carbon monoxide precautions. "As temperatures drop and the risk for carbon monoxide poisoning increases, Kentuckians are urged to be aware of the dangers of carbon monoxide (CO) poisoning due to improper use of heating or cooking devices."

This information can be shared with patients and the general public to prevent dangerous situations.

The Cabinet for Health and Family Services (CHFS) has issued an emergency regulation, 900 KAR 5:020E, to reverse changes made to Certificate of Need (CON) criteria for ambulatory surgery centers (ASCs) in the 2015 update to the State Health Plan. KHA counts this as a major victory and commends Governor Matt Bevin and CHFS Secretary Vickie Yates Brown Glisson for their leadership on this issue.

In 2015, significant and problematic changes were made to the State Health Plan under the Beshear administration, which created numerous exceptions to the ASC criteria. These exceptions allowed for the unnecessary proliferation of ASCs regardless of existing capacity available in ASCs and hospital outpatient surgery departments or need for new services identified in the population. The Cabinet for Health and Family Services (CHFS) is collecting health services utilization data through the annual survey process. This data is published in a report each year and is critical information used for health care access, planning and the Certificate of Need (CON) Program. CEOs should have received an email from Beth Morris (betha.morris@ky.gov) as well as a letter by mail with instructions for completing the hospital, surgery and megavolt/Pet/MRI surveys.

Please make sure the appropriate person in your organization completes these surveys and returns them as soon as possible to Morris. If you have questions or you do not receive the survey requests, contact Morris in the Office of Health Policy at the Cabinet for Health and Family Services.

The Cabinet for Health and Family Services (CHFS) in partnership with the Medicaid managed care organizations (MCOs) is once again sponsoring forums across Kentucky in August and September. These forums are designed to allow any and all health care providers (including behavioral health and substance use providers) who have contracts with MCOs and serve Medicaid consumers to meet face-to-face and discuss concerns about proper billing, prior authorizations, prompt pay, appeals processes or any other specific issues related to the continued implementation of Managed Care. In attendance will be senior level staff from each MCO, senior staff from the Department for Medicaid Services and Department for Behavioral Health, Developmental and Intellectual Disabilities.

As the State Innovations Model (SIM) grant process continues through the Cabinet for Health and Family Services, please be aware there are changes in the meeting schedule for face-to-face meetings on SIM in Frankfort and for KHA’s prep and debriefing calls. Especially note that KHA will hold a planning call from 2:00 - 3:00 p.m. (ET) on Friday, June 12 instead of Monday, June 15. Moving forward, KHA will host one monthly prep call prior to workgroup meetings and one debriefing call following workgroup meetings.

On Friday, May 15, the Cabinet for Health and Family Services (CHFS) will host a forum on the role of Kentucky's rural hospitals in the State Innovation Model (SIM) health system transformation project that is underway in Kentucky. It will be held from 9:00 a.m. to 12:00 p.m. (ET) at the Department of Public Health Conference Suites in Frankfort. The meeting will explore health system transformation models that have proven effective for smaller and rural hospitals in other states, and the potential relevance of the models to Kentucky.

Coroners, funeral home personnel, physicians and others responsible for the registration of death certificates will soon be required to electronically file information needed to complete death certificates, using the Kentucky Electronic Death Registration System (KY-EDRS).  

The change will take effect January 1, 2015, phasing out the paper based system currently used by the Office of Vital Statistics in conjunction with electronic reporting.  The transition to exclusive electronic filing, mandated by state law, is anticipated to speed the process, while maintaining the accuracy and security of the records.

In June,the Cabinet for Health and Family Services proposed significant changes to 900 KAR 6:070 (The Certificate of Need Regulation on Formal Review). The proposed changes included removal of the requirement for an applicant to demonstrate geographic need during the formal review process. There are five separate and distinct criteria identified in statute that an applicant must meet for a Certificate of Need (CON) to be awarded including criteria in the State Health Plan and demonstration of need in the area where the services is being proposed, which are two separate criteria. The Cabinet proposed that an application would meet the geographic need criteria if the application was consistent with the need identified through criteria in the state health plan and the inventory of service utilization published annually. The Interim Joint Committee on Health and Welfare met in Frankfort on August 4. During the meeting, Cabinet for Health and Family Services (CHFS) Executive Director of Policy and Budget Beth Jurek discussed the July 1 Executive Order to reorganize CHFS and the administration of Medicaid. She stated the Cabinet is restructuring the department to reflect the change to managed care from fee for service in order to ensure managed care organizations (MCOs) are meeting the requirements of the contracts and monitor the way that clients are receiving services. CHFS is reducing the number of divisions from eight to six, which according to Jurek, will be a net decrease, with no increase in the agency. CHFS is also consolidating information technology services.

The Cabinet for Health and Family Services has filed proposed amendments to 902 KAR 20:008 – License procedures and fee schedule – to substantially increase the annual licensure fees for all health facilities, including hospitals. The Interim Joint Committee on Health and Welfare met in its first interim meeting on June 18 in Frankfort.

Commissioner Mary Begley, Dr. Alan Brenzel, Lisa Lee and staff from the Department for Behavioral Health, Development and Intellectual Disabilities (DBHDID) testified on the closing of the IMPACT Plus Program in Kentucky. IMPACT Plus was created as a Title V “funding stream” for additional behavioral health services with additional providers outside the 14 Community Mental Health Centers in 1997. IMPACT Plus was designed to serve children with high intensity behavioral health needs, who were in or at risk of out-of-home placement, after being required to meet eligibility criteria.

The DBHDID determined that, in current practice, the program is duplicative of the Medicaid managed care organizations (MCOs), which creates inefficiency in program administration and increases cost.

Under the Affordable Care Act (ACA) and regulations revised by the Cabinet for Health and Family Services (CHFS) in January, hospitals can grant presumptive Medicaid eligibility to individuals who qualify under the new Medicaid income eligibility criteria or to pregnant women. In February, the Cabinet’s contractor, HP, conducted webinar training programs for hospital staff. Since that time, KHA has worked with the Department for Medicaid Services (DMS) to obtain answers to additional questions involving presumptive eligibility. The questions and answers are provided below. Please distribute this information to your staff.

Question: If a hospital grants presumptive eligibility (PE) to an individual, is the individual limited to receiving hospital services only from the hospital which granted the PE or may they receive covered services at any hospital? (KHA was advised this was stated in the HP training program.)

DMS Answer: (Lee Guice, DMS) PE coverage is not limited to the hospital which assisted the PE member.
