On May 31, KHA will host a webinar on the Centers for Medicare and Medicaid Services' (CMS) Hospital Improvement Act Proposed Changes presented by Sue Dill Calloway.

CMS has proposed some significant changes to the hospital conditions of participation (CoPs) that every hospital should know including critical access hospitals. This includes changes to nursing, medical records, infection control, QAPI, patient rights and restraint and seclusion. It will also require all hospitals to have an antibiotic stewardship program and what the program should include. It will include a prohibition on discrimination which must be given to patients in writing.

On May 12, the Centers for Medicare and Medicaid Services (CMS) published in the Federal Register a final rule to revise and clarify certain Conditions of Participation (CoPs) and Conditions for Coverage (CfCs) for hospitals, critical access hospitals (CAHs) and other providers, including long-term care facilities, ambulatory surgery centers (ASCs), laboratories, transplant centers, organ procurement organizations, rural health clinics, federally qualified health centers (FQHCs) and intermediate care facilities for intellectually disabled individuals. The rule is largely aimed at reducing burden and eliminating obsolete regulations, and it also responds to stakeholder concerns about current governance-related provisions for hospitals.

Among the most significant changes, CMS will:

On March 27, KHA submitted comments to the Centers for Medicare and Medicaid Services (CMS) regarding the proposed Conditions of Participation (CoP) rule regarding emergency preparedness requirements for Medicare and Medicaid participating providers and suppliers.

The Centers for Medicare & Medicaid Services (CMS) recently issued a proposed rule in the Federal Register that establishes national emergency preparedness requirements for Medicare and Medicaid providers and suppliers to ensure that they adequately plan for both natural and man-made disasters.

The proposed rule addresses emergency preparedness requirements that 17 provider and supplier types must meet in order to participate in the Medicare and Medicaid programs.

This proposed rule could have a significant impact on hospitals. For example, the rule includes language that relates to the behavior of the new electronic health record (EHR) systems during a disaster or emergency, and a requirement that EHR systems be redundantly backed up both in region and out of region.
