Inpatient Rehabilitation Facility (IRF) and Long-term Care Hospital (LTCH) providers are encouraged to review their performance data on each quality measure based on First Quarter 2016 to Fourth Quarter 2016 data, prior to the December 2017 IRF and LTCH Compare refresh, during which this data will be publicly displayed.

Providers have 30 days to review their performance data (September 1, 2017 through September 30, 2017).

Corrections to the underlying data will not be permitted during this time. However, providers can request a CMS review during the preview period if they believe their data is inaccurate.

Yesterday, Kentucky Medicaid Commissioner Steve Miller announced a one-month delay to the implementation of a new Medicaid policy to no longer pay for early elective deliveries (EEDs) unless certain documentation is provided. This will also apply to Medicaid managed care organizations (MCOs). KHA requested the delay to provide additional time for hospitals to obtain more details about the policy and the required documentation, and to implement process changes in their facilities.

Notice of the policy change was initially provided through a June 23, 2017, letter to hospitals, which had a start date of September 1, 2017. Under the addendum, denials will start for claims with dates of service beginning on or after November 1, 2017. Also, hospitals will get a reminder notice of the November 1 effective date on claims paid with dates of service through October 31, 2017, that do not meet the new requirements.

The Centers for Medicare and Medicaid Services (CMS) is proposing to cut payments for most “separately payable Part B drugs” purchased under the 340B program and dispensed to Medicare hospital outpatients in its Medicare Outpatient Prospective Payment System (OPPS) calendar year (CY) 2018 proposed rule. “Separately payable Part B drugs” generally refer to those that have per-day costs about the packaging threshold, pass through drugs and certain antiemetics. CMS proposes payment at Average Sales Price (ASP) minus 22.5%, rather than ASP plus 6% (the current payment rate), for a nearly 30% cut.

Yesterday, KHA sent the chief financial officer of each 340B hospital paid under the OPPS a brief survey regarding the impact of this payment cut. KHA will summarize this data in support of its comments to CMS (due September 11)  opposing these cuts.

The Kentucky Department for Medicaid Services (KY DMS) is clarifying coverage for early elective deliveries (EED) including non-medically necessary inductions and cesarean deliveries. Claims submitted for labor inductions or cesarean sections on or before 39 weeks gestation that are not properly documented as medically necessary will be denied by Kentucky Medicaid including Kentucky Medicaid Managed Care Organizations (MCOs).

KY DMS's goals are to: 1) guide providers and hospitals to sound practice recommendations made by AGOG; 2) reduce morbidity in neonates from birth trauma and fetal immaturity; 3) reduce non-medically necessary deliveries less than 39 weeks gestation and; 4) encourage greater collaborations between hospitals and their physicians in developing quality improvement initiatives aimed at improving birth outcomes in Kentucky.

Most laws that made it through the Kentucky General Assembly earlier this year take effect on Thursday, June 29. The exceptions were those that had emergency clauses that triggered them to take effect immediately and those that specified later effective dates.

Of special note for hospitals are the Family Caregiver Act, which allows an inpatient to designate a caregiver to be recorded in the medical record and notified prior to the patient’s discharge, as well as the mammography bill, which will require a notification on certain results which involve dense breast tissue.

With the implementation of the Affordable Care Act (ACA), the Centers for Medicare and Medicaid Services (CMS) requires all ordering, referring and prescribing providers to be enrolled in the state Medicaid program. Further, all Attending Providers must also be enrolled in Kentucky Medicaid and be eligible on the claim's date of service.

The Department for Medicaid Services implemented new claim editing to monitor this requirement on April 1, 2017. As such, this requirement is applicable to all claims with dates of service beginning on that date and going forward. In order to allow providers time to comply with this requirement, claims with dates of service between April 1. 2017, and July 1, 2017, that do not meet this requirement will continue to be paid and providers will receive an "informational" EOB indicating that incorrect Attending Provider data has been submitted.

The Centers for Medicare and Medicaid Services (CMS) has extended the attestation deadline for providers participating in the Medicare Electronic Health Record (EHR) Incentive Program to Monday, March 13, 2017, at 11:59 p.m. (PT).

The deadline for Eligible Professionals (EPs) to submit Reconsideration forms for the 2017 payment adjustment — based on the 2015 electronic health record (EHR) reporting period — is February 28, 2017. No applications will be accepted after the deadline.

Reminder for all rural hospitals participating in the 340B Drug Pricing Program: The recertification period began August 5 and ends September 9. Participating hospitals have until September 9 to ensure program compliance and recertify in the 340B database maintained by the Office of Pharmacy Affairs. Each participating hospital or covered entity should have already received an email with the username and password necessary to complete recertification. Eligible professionals now have until 11:59 p.m. (ET) on March 20 to attest to meaningful use for the Medicare Electronic Health Record (EHR) Incentive Program 2014 reporting year.

The Centers for Medicare and Medicaid Services (CMS) extended the deadline to allow providers extra time to submit their meaningful use data. CMS continues to urge providers to begin attesting for 2014 as soon as they can.

This extension also allows eligible professionals, who have not already used their one “switch,” to switch programs (from Medicare to Medicaid, or vice versa) for the 2014 payment year until 11:59 p.m. (ET) on March 20. After that time, eligible professionals will no longer be able to switch programs.

Medicare eligible professionals must attest to meaningful use every year to receive an incentive and avoid a payment adjustment. Providers who successfully attest for the 2014 program year will:

Eligibility in the 340B Drug Pricing program is reviewed annually by the Office of Pharmacy Affairs (OPA) and Covered Entities are required to recertify as a part of this process. Hospitals and safety net providers are currently up for recertification, and they must complete the process by September 10.

OPA recently sent email notifications about the recertification process to the Primary Contact and Authorizing Official for each Covered Entity. If your facility participates in 340B, please look for the email and begin the recertification process.

The Centers for Medicare and Medicaid Services (CMS) has awarded new quality improvement organization (QIO) contracts. For the first time, CMS restructured the QIO program by separating the QIO’s case review work from the quality improvement work, and issued separate requests for proposals (RFPs) and contracts for each. Two contracts were awarded to Beneficiary and Family Centered Care QIOs (BFCC-QIO) to perform case reviews, quality of care reviews, diagnosis-related group (DRG) reviews, EMTALA reviews, appropriateness of setting reviews, medical necessity reviews, readmission reviews, Physician Acknowledgment Statement monitoring, appeals and sanctions. KePRO (which previously held the QIO contract for Ohio), was awarded the BFCC-QIO contract for Kentucky as well as 32 other states and the District of Columbia. Kentucky hospitals should have received a letter from KePRO indicating they will begin this work August 1, and advising that hospitals should download, sign and return a Memorandum of Agreement (MOA)...

On Monday, April 7, Myers and Stauffer, the contractor conducting the Medicaid Disproportionate Share Hospital (DSH) Audits for Kentucky Medicaid, distributed to hospitals by mail the fee for service (FFS) crossover and managed care organization (MCO) paid claims listing needed to complete the data submission required for the Medicaid DSH Surveys. The revised due date for the DSH survey is now April 25.

Hospitals are encouraged to submit the most complete and accurate data possible, keeping in mind the definition of uncompensated care. The 2011 audit year is the first year that hospitals may be subject to return a portion of their DSH payments if they are unable to document uncompensated care cost in excess of their Medicaid DSH payments received. In prior years since the findings were informational and hospitals were not subject to recoupments, many hospitals may not have filed all uncompensated care cost. Instead, they just filed enough cost to “cover” the amount of Medicaid DSH received.

According to a News Flash from the American Hospital Association, the Centers for Medicare and Medicaid Services (CMS) has delayed the deadlines for reporting certain quality data as part of the inpatient and outpatient quality reporting programs from February 1 to Saturday, February 8, due to the severe weather impacting the southeastern United States. However, this delay applies to all hospitals.

For the inpatient quality reporting (IQR) program, the population and sampling data for chart-abstracted quality measures for the third quarter of 2013 (discharges from July 1 through September 30, 2013) will be due on February 8. For the outpatient quality reporting (OQR) program, the data for chart-abstracted measures, as well as population and sampling data for the third quarter of 2013 (encounters between July 1 and September 30, 2013) will be due on February 8. The deadlines for other IQR and OQR measure data remain unchanged.

REMINDER: CEO-signed Commitment Letters are due to the K-HEN team no later than January 31. Since K-HEN will need to provide a list of hospitals who have returned Commitment Letters on that day, please return your letter as soon as possible. Commitment letter packets were mailed to all participating hospitals’ CEOs, along with CEOs of hospitals who did not participate previously but are invited to join this year.

On Friday, January 10, the Kentucky Hospital Engagement Network (K-HEN) held a webinar to discuss hospital commitments for the 2014 extension of the HEN project. A recording of the webinar, along with a copy of the PowerPoint presentation and participation requirements document (regarding data) are available on the K-HEN website, www.k-hen.com.

Please note, the commitment form must be signed by each participating hospital's chief executive officer by January 31. K-HEN will send commitment packets (including the commitment form) to hospital CEOs early this week.  The packet will also include an outline of the data submission requirements, recommended measures and an outline of the data submission and performance incentive program. K-HEN will copy this information in an e-mail to hospital quality leaders.  System-level commitment forms will not be accepted by the Hospital Research and Education Trust (HRET) and the Centers for Medicare and Medicaid Services (CMS), so the forms must be signed by individual hospital CEOs....
