The 2017-2019 State Health Plan will go into effect on January 5, 2018. The Office of Health Policy issued the proposed State Health Plan in July and the final State Health Plan with the statement of consideration was released on October 13.

Overall, KHA and its member hospitals were pleased with the outcome. The Cabinet accepted KHA’s comments to allow hospitals to establish home health services if they can demonstrate difficulty in placing patients. Unfortunately, no changes were made to the PRTF Level II criteria; although, when KHA staff met with the Cabinet, they acknowledged the need for more access to this level of care and indicated a desire to continue to work on this with KHA.

On or about December 20, the Centers for Medicare & Medicaid Services (CMS) will likely update its Hospital Compare website with new star ratings and release the list of hospitals receiving Hospital-Acquired Condition (HAC) penalties for fiscal year (FY) 2018. Corrections to the star ratings calculations likely mean that significantly fewer hospitals will receive a three-star rating this year than last. As a result, many more hospitals will receive four or five stars, while additional hospitals will receive one or two-star ratings. In the past, release of the HAC payment penalty list and the star ratings have generated media attention.

Electronic Health Record (EHR) Incentive Program attestation for Medicare eligible hospitals and critical access hospitals (CAHs) is transitioning to a new platform. Beginning January 2, 2018, eligible hospitals and CAHs attesting to CMS for the EHR Incentive Program will submit their CY 2017 attestations through the QualityNet Secure Portal (QNet).

Eligible hospitals and CAHs attesting to CMS must have an active and updated QNet account before submitting EHR Incentive Program attestations.

The Kentucky Medicaid Electronic Health Record (EHR) Incentive Program will accept attestations for Program Year 2017 Meaningful Use beginning Thursday, November 30 at 8:00 a.m. (ET). 

The user manual for Program Year 2017 is located on the EHR website at http://chfs.ky.gov/dms/EHR.htm under the Manuals section. The deadline to submit an attestation for Program Year 2017 is 11:59 p.m. (ET), March 31, 2018. Any attestation that is in process after that time will be closed out and not eligible for participation.

The Kentucky Society for Healthcare Engineers is hosting a special event on December 7 featuring John Maurer with The Joint Commission and Sharon S. Gilyeat with Koffel Associates where participants will take a deep dive into the current code updates and standards that impact hospital facility managers and engineers in Kentucky.

The Office of Health Policy (OHP) has updated the State Health Plan to include a Pilot program to allow for the establishment of short- term transitional care beds. The Pilot limits approval of a total of four programs - two urban-based applicants and two rural-based applicants. The service would be licensed as a nursing facility bed and is open to any type of applicant. The new service could be created within an existing health facility, like a hospital, or it could be a free-standing facility.

ACTION NEEDED on TRANSITIONAL CARE BED SERVICE

The changes to the State Health Plan could go into effect as soon as December 15, which means applicants interested in applying for the pilot program would be required to meet the December 27 application filing deadline. It is anticipated the application process will include a competitive hearing process and there will be multiple applicants. Yesterday, the American Hospital Association (AHA), the Association of American Medical Colleges (AAMC) and America’s Essential Hospitals filed a lawsuit against the U.S. Department of Health and Human Services (HHS) in the U.S. District Court for the District of Columbia to prevent significant Medicare payment cuts for hospitals that participate in the 340B Drug Pricing Program. The three hospital associations are joined in the suit by hospital plaintiffs: Eastern Maine Healthcare Systems, in Brewer, Maine; Henry Ford Health System, in Detroit; and Park Ridge Health, in Hendersonville, North Carolina, part of Adventist Health System.

For 25 years, the 340B program has enabled hospitals and other organizations that care for many low-income and uninsured patients to purchase certain outpatient drugs from pharmaceutical manufacturers at discounted prices. On Thursday, November 9, the Kentucky Society for Healthcare Public Relations and Marketing (KSHPRM) held its annual Thoroughbred Awards. The awards luncheon, held in conjunction with the KSHRPRM fall conference at the Hilary J. Boone Center at the University of Kentucky, honored and recognized excellent work throughout the commonwealth in the areas of health care marketing and public relations.

Organizations were eligible to submit entries in 34 categories ranging from television advertising to direct mail design, community events and social media campaigns. This year, entries were judged by the Georgia Society for Marketing and Public Relations. In total, 83 entries were submitted for consideration. Entries receiving 4.5 to 4.9 points earned a Certificate of Merit, while those receiving 5 points and higher earned Thoroughbred Award statues. Thus, there were 24 Thoroughbred Awards and 30 Certificates of Merit presented at the event.

KHA and the K-HIIN group recently recognized Teresa Daniels, infection prevention (IP) at Clark Regional Medical Center and Bourbon Community Hospital as the latest Patient Safety Hero Awardee. The Tax Cuts and Jobs Act, H.R. 1, was released and is being debated this week in the U.S. House Ways and Means Committee. There is a significant problem for the Kentucky not-for-profit hospitals included in the bill. The proposal would eliminate the tax-exemption for private-activity bonds (PABs), including qualified 501(c)(3) hospital bonds and advance refunding bonds. The ability to obtain tax-exempt financing is a key benefit of hospital tax-exemption that works to make access to vital hospital services available in communities large and small across the commonwealth.

These bonds play a critical role in helping not-for-profit hospitals and health systems access low-cost capital, enabling them to keep infrastructure expenditures low so they can efficiently fulfill their mission and focus on the work they do for the public good. Tax-exempt bonds reduce hospitals’ borrowing costs because they normally can be sold at a lower rate of interest than taxable debt of comparable risk and maturity....
