The KHA membership recently approved an amendment to the KHA Bylaws to open membership to inpatient facilities other than hospitals, which generally provide long-term, skilled, intermediate, personal and/or assisted-living care and are located in Kentucky. Additionally, a representative from the Long-Term Acute Care Hospital Forum was added as a member of the KHA Board of Trustees.

KHA will host a live careLearning User Group meeting on Thursday, June 5, at KHA Headquarters in Louisville. Registration begins at 8:00 a.m. (ET) and the meeting will conclude at 3:30 p.m.

This meeting is designed for Kentucky health care organizations who are using careLearning in their facilities, or who would like more information about the program. The objective of the meeting is to provide a forum for local users to exchange information about careLearning and share experiences. KHA staff met with a delegation of Russian physicians through the Open World ProgramOn May 29, KHA staff hosted a group of Russian physicians as part of the World Affairs Council (WAC) of Kentucky and Southern Indiana Open World Program. The Open World program focuses both on assisting the Council in its oversight responsibilities and on conducting exchanges that establish lasting professional relationships between the up-and-coming leaders of Open World countries and Americans dedicated to showcasing U.S. values and democratic institutions. The WAC has participated in the Open World Program since its inception, and is experienced in all types of professional and cultural programming for Open World Delegations.

KHA has produced  a report for its members on payments and denials from Medicaid managed care organizations (MCOs). The report includes prompt pay and prior authorization data from the second quarter of 2012 through the third quarter of 2013. The data is all derived from state sources.

A federal court late Friday ruled in favor of the Pharmaceutical Research and Manufacturers of America (PhRMA) and against the Department of Health and Human Services (HHS) in a lawsuit seeking to exclude all drugs with an "orphan" designation from the 340B Drug Pricing Program expanded to rural and cancer hospitals under the Affordable Care Act. As a result of the ruling in the U.S. District Court for the District of Columbia, HHS's final rule is no longer in effect. The rule, which was issued in 2013, allowed certain 340B hospitals (critical access, sole community providers, rural referral centers and freestanding cancer hospitals) to purchase orphan drugs through the 340B program if they did not use the drugs for the treatment of conditions for which the orphan drug designation was given. AHA filed a friend-of the-court brief in December supporting HHS.

AHA and KHA will provide 340B hospitals more information on the court decision and its impact on hospitals.

The Centers for Medicare and Medicaid Services (CMS) made the following announcement on Thursday, May 22. Please note, prior authorization is expanding in Kentucky for more durable medical equipment for Medicare patients. Links for additional information are available at the bottom of the announcement from CMS.

CMS has announced plans to expand a successful demonstration for prior authorization for power mobility devices, test prior authorization in additional services in two new demonstration programs, and propose regulation for prior authorization for certain durable medical equipment, prosthetics, orthotics and supplies. Prior authorization supports the administration’s ongoing efforts to safeguard beneficiaries’ access to medically necessary items and services, while reducing improper Medicare billing and payments. The proposed rule is estimated to reduce Medicare spending by $100 to $740 million over the next ten years.

KHA has created a new Post Acute Care (PAC) Leaders Forum in light of the many post acute care reform proposals put forth by the Medicare Payment Advisory Commission (MedPAC), the Obama Administration and the Bipartisan Policy Center (BPC) — all of which have various implication on the post acute care delivery system. Proposals have included Site Neutral Payment, Inpatient Rehabilitation Facility (IRF) 75% Rule, Skilled Nursing Facility (SNF) Readmission Penalty and Bundled Payment.

As outlined in Article VII of the KHA Bylaws concerning forums, the new Post Acute Care Leaders Forum will convene for the purpose of providing opportunities to collaborate, network and educate on related issues and make recommendations to the KHA Board of Trustees on Policy issues impacting services related to post acute care.

The Connecticut Hospital Association shared the following incident with the Kentucky Institute for Patient Safety and Quality (KIPSQ), KHA’s Patient Safety Organization, for distribution to its members in the hopes that it will prevent a harm event in hospitals.

On May 16, Griffin Hospital in Derby, Connecticut, announced that during a daily safety huddle (begun as part of the hospital’s participation in their statewide high reliability collaborative), it had identified an issue regarding the use of insulin pens — devices intended to make insulin injections more efficient and accurate. They consist of a cartridge and needles. While needles were never reused, a few staff used the cartridges for more than one patient. Despite changing the needles, there is still slight risk of blood contamination of the pen reservoir or cartridge, which could result in transmission of blood-borne pathogens from the previous patient.

KHA’s Washington-based Medicare consultant, Larry Goldberg, will present a webinar on the 2015 Inpatient Prospective Payment System (IPPS) Proposed Rule released on Wednesday, April 30. The webinar is scheduled for THURSDAY, MAY 29, starting at 2:00 p.m. (ET).

Goldberg has over 40 years of health care experience and is a well-known and respected expert in Medicare and health care financial legislation and regulations. He will focus on the payment update factors as well as the impact of the Centers for Medicare and Medicaid Services' (CMS’) proposal on hospital-acquired conditions, hospital readmissions and value-based purchasing. On June 1, the Office of Health Policy will publish proposed changes to the following three Certificate of Need regulations: (1) Certificate of Need Non-substantive Review, (2) Certificate of Need Considerations for Formal Review, and (3) Certificate of Need Forms. ( A copy of each of these proposed amendments is available at the corresponding links.) These regulations were not filed as emergencies, and comments will be accepted through June 30. Dennis Johnson Sworn in as KHA Board ChairThe highlight of KHA's 85th Annual Convention was the swearing in of Dennis Johnson, president of Hardin Memorial Health in Elizabethtown, as the 2014-2015 KHA Board Chair during the annual Awards Luncheon (see related article).

He was sworn in by current KHA Board Chair Charles Lovell, chief executive officer of Caldwell Medical Center in Princeton.

Johnson's term will begin July 1.

On May 7, the Department of Health and Human Services (HHS) announced an overall nine percent decrease in hospital acquired conditions (HACs) nationally during 2011-2012. HACs are undesirable situations or conditions for patients that arose during a hospital stay.

HHS reported that national reductions in adverse drug events, falls, infections and other forms of hospital-induced harm are estimated to have prevented nearly 15,000 deaths in hospitals, avoided 560,000 patient injuries and saved approximately $4 billion in health spending over the same period.

Kentucky hospitals are cheering today’s announcement because they played an integral role in improving many of the quality indicators on which HHS focused. Since 2012, the Kentucky Hospital Association has led a statewide initiative to reduce preventable readmissions and HACs in Kentucky hospitals. The Centers for Medicare and Medicaid Services (CMS) planned to conduct ICD-10 testing during the week of July 21 through 25 to give a sample group of providers the opportunity to participate in end-to-end testing with Medicare Administrative Contractors (MACs) and the Common Electronic Data Interchange (CEDI) contractor. The July testing has been canceled due to the ICD-10 implementation delay. Additional opportunities for end-to-end testing will be available in 2015.

On May 1, KHA distributed an electronic survey via e-mail to all Kentucky hospital chief nursing officers and directors of quality. The survey is part of KHA's strategic planning process as the Association begins to plan for sustainability of valuable quality improvement resources to support identified needs. KHA asks every hospital to share some brief information about the quality improvement relationships in which you engage and provide feedback on both the value of the Hospital Engagement Network (HEN) services as well as services provided by other third parties. The survey should take less than 10 minutes to fill out. CNOs or directors of quality should be well positioned to answer the questions which include information about any quality improvement (Q.I.) consulting arrangements you have, the range of services provided within these programs, cost associated with projects, value of services you use and Q.I. needs your hospital has identified for the next three years.

Kosair Children's Hospital, the University of Kentucky College of Pharmacy and UK HealthCare Kentucky Children's Hospital will host a free webinar on May 20 at 2:00 p.m. on Medication Safety for Children in the Acute Care Setting.

The 50-minute program will address medication safety issues for children in the hospital setting. Information from this webinar will help each hospital evaluate its ability to deliver medication in a safe manner to children from the entry point in the acute care setting.

All American College of Healthcare Executives (ACHE) members are invited to the Annual Kentucky ACHE Luncheon on Thursday, May 8, in conjunction with the KHA 85th Annual Convention. A separate registration fee is required for this special event, so be sure to mark your desire to attend when registering for Convention.

Following the luncheon, there will be an ACHE educational session,  which is approved for 3 hours of ACHE Qualified Face-to-Face Education Credit. The cutoff date for the Convention rate on hotel rooms for KHA's 85th Annual Convention, May 8-9, has been extended until Friday, April 25. A block of rooms has been reserved at the Hyatt Regency Lexington. Reservations requests after the cutoff date will be confirmed on an availability basis. On Monday, April 7, Myers and Stauffer, the contractor conducting the Medicaid Disproportionate Share Hospital (DSH) Audits for Kentucky Medicaid, distributed to hospitals by mail the fee for service (FFS) crossover and managed care organization (MCO) paid claims listing needed to complete the data submission required for the Medicaid DSH Surveys. The revised due date for the DSH survey is now April 25.

Hospitals are encouraged to submit the most complete and accurate data possible, keeping in mind the definition of uncompensated care. The 2011 audit year is the first year that hospitals may be subject to return a portion of their DSH payments if they are unable to document uncompensated care cost in excess of their Medicaid DSH payments received. In prior years since the findings were informational and hospitals were not subject to recoupments, many hospitals may not have filed all uncompensated care cost. Instead, they just filed enough cost to “cover” the amount of Medicaid DSH received.
