The Kentucky Department for Public Health recognized its eighteenth trauma center on October 26 when Kentucky Public Health Commissioner Hiram Polk, MD, designated Harlan ARH Hospital as a Level IV Trauma Center at a ceremony during the 2016 Kentucky Trauma and Emergency Medicine Symposium in Lexington.

"Our medical staff, employees and first responders in Harlan County all went above and beyond in their preparations for this achievement and we are very proud of the effort taken to improve the level of emergency service we are able to provide to our community,” stated Donnie Fields, Community CEO of Harlan ARH Hospital. "It has truly been a team effort and a great learning experience for everyone involved with the drills and preparation work required to achieve this status and allows us to provide a higher level of care for our patients."

Kentucky's U.S. Congressmen Andy Barr, Thomas Massie and Hal Rogers signed the House of Representatives Dear Colleague letter and Senator Mitch McConnell wrote his own personal letter to the Centers for Medicare and Medicaid Services (CMS) urging the importance of flexibility during the proposal to implement part of the Bipartisan Budget Act (BiBA) of 2015 concerning the treatment of off-campus outpatient departments.

The letters expressed concern that implementation of the rule could seriously impact rural states, such as Kentucky, and would limit access to care in already underserved areas.

Please take the time to thank the Senator and your Congressman for their support of hospitals in Kentucky.

On Wednesday, September 21, the Drug Enforcement Administration (DEA) announced Louisville as the fourth city in America to take part in a comprehensive law enforcement and prevention “360 Degree Strategy” to assist cities dealing with the heroin and prescription drug abuse epidemic. As part of this strategy and in conjunction the U.S. Attorney’s Office for the Western District of Kentucky, the Partnership for Drug-Free Kids and the Benevolent and Protective Order of Elks you are cordially invited to attend a DEA 360 Strategy Drug Prevention “Train-the-Trainer” briefing held at one of two locations on November 1 and 2.

On November 1, KHA will host a webinar to assist hospital staff learn more about the regulations and laws that surround The Joint Commission (TJC) Standard 01.07.01, and help make sure they are in compliance. TJC Leadership Standard 01.07.01 requires the board, senior managers and leaders of the medical staff to have knowledge of various health care laws and regulations.

Because of the health care reform federal law changes, this program will cover the important laws that every hospital should be aware of. It will provide information on how to locate a copy of the laws and the importance of updating policies and procedures to be compliant with these federal laws. This session will also discuss some of the many changes in federal regulations and interpretive guidelines by the Center for Medicare and Medicaid Services (CMS) regarding the hospital conditions of participation (CoPs) which must be followed by every hospital that accepts Medicare or Medicaid.

The final meetings of the KHA Summer Series of Congressional Meetings will be held October 17 and November 3 in the fourth and fifth congressional districts.

Each meeting in the Series is held in the congressmen’s districts to provide KHA members the opportunity to stay in contact locally with the Kentucky congressional delegation and discuss important legislative and regulatory issues currently before the U.S. Congress that are critical to Kentucky’s hospitals. With the nation’s health care system in transformation to delivery systems that are driven by new payment models, hospitals must stay in contact with their Congressman to let him know how these changes will impact your hospital, and this meeting provides you with the opportunity to discuss your issues and concerns.

The Cabinet for Health and Family Services (CHFS) has issued an emergency regulation, 900 KAR 5:020E, to reverse changes made to Certificate of Need (CON) criteria for ambulatory surgery centers (ASCs) in the 2015 update to the State Health Plan. KHA counts this as a major victory and commends Governor Matt Bevin and CHFS Secretary Vickie Yates Brown Glisson for their leadership on this issue.

In 2015, significant and problematic changes were made to the State Health Plan under the Beshear administration, which created numerous exceptions to the ASC criteria. These exceptions allowed for the unnecessary proliferation of ASCs regardless of existing capacity available in ASCs and hospital outpatient surgery departments or need for new services identified in the population.
