A U.S.-led airstrike January 3 in Iraq eliminated Qassem Soleimani, the head of the Iranian Revolutionary Guard Corps (IRGC)-Quds Force, a U.S.-designated Foreign Terrorist Organization. Although the U.S. government has not identified a specific threat from Iran targeting U.S. health care, the public has been asked to remain vigilant for physical and cyber-based suspicious activity.

Many in the U.S. government believe that Iran will attempt a retaliatory strike against U.S. interests overseas or potentially against U.S. critical infrastructure via a cyberattack. Iran has used cyberattacks to conduct retaliatory strikes against the U.S. in the past and possesses a significant offensive cyber capability, including the ability to destroy data, disrupt computer networks and cause significant financial loss. The Department of Health and Human Services (HHS) Assistant Secretary for Preparedness and Response (ASPR) released the following guidelines for hospitals and health care facilities to consider to ensure they are prepared for possible attacks on public infrastructure.

In collaboration with HC3, H-ISAC, DHS and the law enforcement community, ASPR is actively monitoring an increase in malicious cyber activities as result of heightened tensions between the United States and Iran. In the past, the Iranian regime actors and proxies have initiated destructive attacks against United States infrastructure; however, there are currently no specific, credible threats against U.S. infrastructure.

In collaboration with the Department for Medicaid Services (DMS) and Centers for Medicare & Medicaid Services (CMS), the Kentucky Health Information Exchange (KHIE) is offering Pharmacies, Eligible Providers (EPs), Eligible Hospitals (EHs) and Critical Access Hospitals (CAHs) the opportunity to apply for a mini-grant to offset the vendor fees associated with connecting to KHIE.

The Provider Assistance Program was created to help Pharmacies, EPs, EHs and CAHs in rural areas of the state to mitigate the challenges associated with interoperability. The objective is to relieve a degree of the financial burden a health care facility experiences which hinders engagement in Public Health and Clinical Data Registry reporting as well as Health Information Exchange.

Applicants are required to be located in the state of Kentucky and considered an EP, EH or CAH (as defined by CMS) or a licensed pharmacy. If approved, EHs and CAHs may be awarded up to $15,000 and Pharmacies and EPs may be awarded up to $8,000. Warnick Retirement PhotoToday, KHA staff celebrated the long and successful career of Chuck Warnick, Vice President of Data Analysis and Planning. He will retire at the end of the year, but will continue as a consultant to the Association for its strategic planning process in 2020.

Warnick joined KHA in 2007 to oversee the operation of the Discharge Data Set Program and has been instrumental in the development and the statewide use of KHA InfoSuite, the state database decision support tool available to members at no extra cost. Congressional leaders reached a $1.37 trillion spending agreement yesterday, which would repeal several ACA taxes (e.g, Cadillac tax, health insurer tax and medical device tax), delay payment cuts to disproportionate share hospitals (DSH) until May 22, 2020, and fund gun violence research.

While Congress was negotiating the agreement, KHA contacted the Kentucky congressional delegation to once again urge them to delay Medicaid DSH cuts for a full year. This morning, the American Hospital Association (AHA) and other national organizations, along with individual hospitals from Nebraska, Missouri and California, filed suit against the federal government challenging the Centers for Medicare & Medicaid Services (CMS) final rule mandating that hospitals disclose their privately negotiated rates with commercial health insurers.

Per an AHA email, “The lawsuit asks the U.S. District Court for the District of Columbia for relief by making the case that the U.S. Department of Health and Human Services lacks statutory authority to require and enforce a provision that mandates public disclosure of individually negotiated rates between commercial health insurers and hospitals. Additionally, the lawsuit makes the argument that the provision violates the First Amendment by compelling the public disclosure of individual rates negotiated between hospitals and insurers in a manner that will confuse patients and unduly burden hospitals.”

Following a request for proposal (RFP) process and a state procurement procedure through the Finance and Administration Cabinet, the Department for Medicaid Services (DMS) within the Cabinet for Health and Family Services (CHFS) has been notified of five new statewide contract awards for managed care organizations (MCOs). Aetna Better Health of Kentucky, Humana Health Plan, Inc., Molina Healthcare of Kentucky, UnitedHealthcare DBA UnitedHealthcare Community Plan of Kentucky and WellCare Health Insurance of Kentucky have been selected to serve Kentucky’s approximately 1.3 million Medicaid beneficiaries beginning July 1, 2020, when the current contracts expire.

Hospitals should have already received a notice indicating the expected amount of State Fiscal Year (SFY) 2020 Disproportionate Share Hospital (DSH) distribution. The allotment for the pools assume full funding by the Centers for Medicare and Medicaid Services (CMS) — it anticipates that the cuts scheduled for this year will be permanently delayed until a future period.If the cuts are not delayed, the total funding will be reduced by approximately 37%.

For the acute care pool, no monies were transferred from the University pool this year (which results in a reduction in the pool compared to last year).

Disbursements are expected on November 27, 2019.
